The wrangling between the Chairman of the Independent Electoral and Boundaries Commission Wafula Chebukati on one hand with his deputy Juliana Cherera on the other reached a new level on Tuesday.

During the pretrial hearings at the Supreme Court, former Attorney General Prof Githu Muigai and Senior Counsel Paul Muite both claimed to hold briefs for the Independent Electoral and Boundaries Commission (IEBC).

Githu Muigai represents the faction headed by Chairman Wafula Chebukati while Paul Muite represents the dissenting faction of Cherera, Francis Wanderi, Justus Nyang’aya, and Irene Masit.

“This court cannot deal with the issue or any dispute as to the legal representation of the IEBC. It is not the business of the court to determine who represents the IEBC,” Deputy Chief Justice Philomena Mwilu gave the directive.

She thought that such a dispute on who represents the commission should not divert from the weighty matter of making a timely determination on the petition.

“That is an internal issue that must be resolved by the IEBC internally,” DCJ Mwilu emphatically stated.
