President Ruto Dismisses Justice Mohammed Kullow, Appoints Tribunal to Probe Him

President William Ruto has suspended Justice Mohammed Kullow and appointed a tribunal to inquire into allegations of gross misconduct leveled against him.

The suspension followed recommendations of the Judicial Service Commission (JSC).

Through a gazette notice dated March 8, Ruto appointed Appellate Judge Patrick Kiage as chairman of the tribunal.

The gazetted members are Justice Margaret Njoki Mwangi, Justice Anthony Charo Mrima, Jinaro Kipkemoi, Wanjiru Mwariri, Rukia Abdinasir Mohamed and Charles Mulila.

The mandate of the tribunal will be to consider four petitions for the removal of Kullow from office.

The probe team will also inquire into the conduct of the judge in terms of the particulars set out in the petitions and determine whether the allegations therein constitute breach of the provisions of Article 168 of the Constitution.

Ruto said in the discharge of its functions, the tribunal will expeditiously prepare and submit a report and its recommendations thereon.

It shall also exercise all the powers conferred upon it by law for proper execution of its mandate.

JSC recommended the suspension of the Environment and Land Court judge over alleged gross misconduct, incompetence and violation of the Judicial Service Code of Conduct.

Kullow is accused of inordinately delaying or failing to deliver rulings or judgments in a total of 116 matters.

JSC, chaired by Chief Justice Martha Koome, asked Ruto to constitute a tribunal to probe the judge after finding that there were sufficient grounds for his removal from office.

Kullow will now be on half pay as he awaits his fate to be decided by the seven-member tribunal.
