A Sh1.9 billion asset forfeiture case brought against former Migori Governor Okoth Obado, his companies, four children, and a businessman has been dropped by the government. The Ethics and Anti-Corruption Commission (EACC) stated that the specifics are contained in a consent that was presented to Justice Esther Maina yesterday.
EACC said they had privately addressed any remaining issues with Sh235 million and that it would rather not seek after the two instances of Sh 1.9 billion and Sh73 million including unexplained riches and continues of wrongdoing against Obado, his four kids, money manager Jared Peter Oluoch Kwaga and his organizations.
Additionally, the commission requested that the court approve the out-of-court settlement agreement. It also wants the assets, which include a house in Loresho and two high-end vehicles worth Sh15.9 million that Obado and his children allegedly acquired through corruption, to be freed from freezing orders. “I have guidance from the commission (EACC) that the gatherings in this have gone into a settlement understanding date on June 5, 2024. Jackie Kibogy, an attorney for EACC, stated, “We urge the court to admit the settlement consent as the order of the court.”
Judge Maina asked the EACC lawyer, shocked by the new development, if it was justifiable and in the public interest to settle the Sh1.9 billion recovery financial impropriety claim for Sh235 million. Kibogy told the judge that Obado and his co-suspects agreed to surrender two Toyota Land Cruiser V8s and eight prime properties, including the Loresho property, and that the commission agreed to drop the case after the parties agreed to Sh235 million. “As all assets associated with this case have been confiscated in accordance with the agreement, the settlement agreement in this case is justified. She stated, “The defendants have made an offer to surrender, and the commission has accepted to receive eight properties and two motor vehicles, each valued at Sh235,600,000, to be sold at public auction in full and final settlement of the two claims.” Loresho House, worth Sh40 million, Sunrise Centre, a commercial property, and five-story residential blocks in Suna East, each with 20 two-bedroom units, each worth Sh80 million and Sh57.6 million, are among the surrendered assets. In addition, the suspects have surrendered three additional apartments in Greenspan, each valued at Sh18 million to Sh14.5 million, according to the EACC. Other seized properties include a Kamagambo residential property worth Sh10 million and two Suna East prime single-family properties with eight one-bedroom units worth Sh7.5 million.
The legal advisor added that the Sh73 million recuperation suit against Obado and his kids connected with continues of wrongdoing following charges of pay off and payoffs got from Migori District government and was important for the Sh1.9 Million recorded over unexplained abundance. Kibogi stated, “Therefore the assets relating to this matter of Sh73 million are properties acquired in the Sh1.9 billion case, and we seek the withdrawal of both matters.” The judge also overturned the four-year-old order freezing the accounts and all assets, keeping Obado, his children, and several contractors’ billions of shillings worth of assets.
