The High Court in Nairobi on Tuesday November 28, 2023 declared the Housing Levy promulgated by President Ruto Unconstitutional.
The Court pointed out that the Levy violated key provisions of the Constitution including singling out the formal sector for purposes of fleecing Kenya’s workers. Contents of the Housing Levy were set out in the Finance Act of 2023 which has been passed into law by President Ruto.
Should the court ruling be upheld, Kenyans will have been rescued from one of the most repressive elements of Kenya Kwanza’s taxation regimen only equal in abhorrence to the Fuel Levy.
Pronouncing itself on the matter the High Court said the Housing Levy was unconstitutional and lacked a comprehensive legal framework to support it.
Busia Senator Okiya Okoiti Omtatah singlehandedly presented the case in court as religious and civic society watched, clueless of the legal implications involved.
Meanwhile unverified reports indicate that the Treasury has affirmed that all money’s collected from Kenyans as part of the Housing Levy are non-refundable.
